1 – General Provisions

1.1 - By accessing this section, the user enters the website of Curno Accessori S.r.l., available at www.negoziboschini.it. Browsing the website and submitting a purchase order imply acceptance of these Terms and Conditions as well as the Data Protection Policies adopted by the website and indicated therein.
These General Terms and Conditions of Sale apply to the sale of products exclusively with reference to purchases made on the website in accordance with the provisions of Part III, Title III, Chapter I of the Italian Consumer Code (Legislative Decree No. 206/2005, as amended by Legislative Decree No. 21/2014 and Legislative Decree No. 70/2003) by: AEFFE Lab S.r.l.

The Seller offers products for sale on www.negoziboschini.it and conducts its e-commerce activity exclusively towards its end users who qualify as “consumers”.

1.2 - “Consumer” shall mean any natural person who acts on www.negoziboschini.it for purposes unrelated to any commercial, business, craft, or professional activity they may carry out. Users who do not fall within the definition of “consumer” are required to refrain from entering into commercial transactions on www.negoziboschini.it.

1.3 - In line with its commercial policy, the Seller reserves the right not to process orders submitted by parties other than “consumers” or any orders that do not comply with its commercial policy.

1.4 – These General Terms and Conditions of Sale govern exclusively the offering, submission, and acceptance of purchase orders for products on www.negoziboschini.it between the users of www.negoziboschini.it and the Seller.

1.5 - These General Terms and Conditions of Sale do not govern the provision of services or the sale of products by parties other than the Seller that may be present on www.negoziboschini.it through links, banners, or other hyperlinks. Before placing orders or purchasing products and services from parties other than the Seller, users are required to review their respective terms and conditions of sale. The Seller shall not be liable for the provision of services by third parties nor for the completion of e-commerce transactions between users of the website and such third parties.

2 - How to conclude the contract with the Seller

2.1 - To conclude a purchase contract for one or more products on www.negoziboschini.it, the User is required to complete the electronic order form and submit it to the Seller electronically, following the relevant instructions.

2.2 - The order form includes a reference to the General Terms and Conditions of Sale, the product description, quantity and related price, available payment methods, as well as a reference to the conditions governing the right of withdrawal and the procedures and timeframes for returning purchased products. Before completing the contract, the User is required to confirm that they have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and the processing of personal data. The contract is considered concluded when the Seller receives the completed order form, subject to verification of the accuracy of the data contained therein. The Buyer is obliged to pay the price from the moment the online order process is completed, by selecting the “Confirm order” button at the end of the guided procedure.

2.3 - The order form shall be stored in the Seller’s database for the period necessary to process and fulfil the orders and, in any case, in accordance with applicable legal requirements. The User may access their order form by consulting the “Orders” section.

2.4 - The languages available for concluding the contract with the Seller are Italian and English. Once the contract has been concluded, the Seller will process the order for the purpose of its fulfilment.

2.5 - The Seller reserves the right not to process purchase orders that are incomplete or incorrect, or in the event of product unavailability or non-payment. In such cases, the User will be informed by email of the failure to conclude the contract and the related reasons.If the products displayed on www.negoziboschini.it are no longer available or on sale at the time of the User’s last access to the website or submission of the order form, the Seller shall promptly inform the User, and in any case within thirty (30) days from the day following the transmission of the order, of the unavailability of the ordered products.In the event that the order form is submitted together with payment of the price, the Seller shall refund, without undue delay, any amounts already paid, and the contract shall be deemed terminated between the parties.

2.6 - By electronically submitting the order form, the User unconditionally accepts and undertakes to comply, in their dealings with the Seller, with these General Terms and Conditions of Sale. Should the User not wish to accept even partially these terms and conditions, they must refrain from submitting the order form for the purchase of products on www.negoziboschini.it.

2.7 - Once the contract has been concluded, the Seller shall send the User an email confirming receipt of the purchase order.

3 - Warranties and Product Pricing

3.1 - Products from various brands are offered for sale on www.negoziboschini.it.

3.2 - The Seller does not sell used or irregular products.

3.3 - The essential characteristics of the products are presented on www.negoziboschini.it. However, images and colours of the products offered for sale on www.negoziboschini.it may not correspond exactly to the real ones due to the Internet browser and monitor used.

3.4 - Product prices may be subject to updates. The User is required to verify the final sale price before submitting the relevant order form.

3.5 - Purchase requests originating from countries not included among those displayed on the website cannot be accepted by the Seller.

3.6 - Products are provided with identifying elements that guarantee their integrity. Such elements must not be removed or altered in order to exercise the right of return.

3.7 - In the event of exercising the right of withdrawal, the Seller reserves the right to refuse the return of products or to issue a partial refund if the items are found to be missing their identifying elements, or if they have been used, damaged, or altered in their essential or qualitative characteristics.

4 – Payments

4.1 Payment of the price of the products and of the related shipping and delivery costs shall be made according to the methods indicated in the order form. Under no circumstances shall costs higher than those actually incurred by the Seller in relation to the chosen payment method be charged.

4.2 Orders may be paid by credit card, PayPal, Shop Pay, Klarna,  Apple Pay, and Google Pay. Apple Pay and Google Pay are available exclusively on supported devices.

4.3 In the case of payment by credit card, financial information (such as credit/debit card number and expiry date) is transmitted via encrypted protocol to PayPal or another electronic payment service provider appointed to manage remote payment services, without any possibility of access by third parties.Such information is used by the Seller solely for the completion of the purchase process, for any refunds in the event of product returns following the exercise of the right of withdrawal, or for the prevention or reporting of fraud to the competent authorities.The price of the products and shipping costs indicated in the order form will be charged to the Buyer’s account at the time of shipment of the products.

4.4 Orders placed via Klarna are delivered immediately, while payment is made in instalments. Instalment payments may be assigned to Klarna, related entities, or their assignees, and such assignment is hereby authorised.
4.5 The online store operates from within the European Union and all transactions are carried out in Euro, unless otherwise stated.

5 - Discount Codes

5.1 - I Discount codes are personalised codes that allow users to obtain a discount on purchases made on www.negoziboschini.com.

5.2 - The field for entering the discount code is displayed on the first page of the checkout process. After adding items to the Cart, the code may be entered in the dedicated field in order to apply the discount.

5.3 – Restrictions on the use of discount codes:
A) Discount codes with monetary value cannot be converted into cash;
B) It is not permitted to use more than one discount code per order, except in exceptional cases expressly provided for by the Seller;
C) Discount codes are not valid for products already subject to promotion, except in exceptional cases expressly provided for by the Seller.

6 – Shipping and Delivery of Products

6.1 The information contained in this section forms an integral and essential part of the General Terms and Conditions of Sale and is deemed to be fully known and accepted by the Buyer at the time of submission of the order form.The Seller ships to Italy, Vatican City, San Marino, and the European Union, using trusted courier services.

Shipping costs:

  • Italy, Vatican City, and San Marino:
    • Free for orders over €180.00
    • €7.00 for orders under €180.00
  • EU countries: €10.00

For in-store pickup orders, no shipping fees apply.

6.2 - Goods are prepared and delivered within 48–72 hours from the shipping date for orders destined for Italy, Vatican City, and San Marino. For EU countries, delivery times range from 3 to 5 working days from the shipping date.Orders placed on Friday after 12:00 p.m., as well as those received on Saturday or Sunday, will be handed over to the courier within 1–2 working days. Delivery times are purely indicative and, although generally respected, cannot be guaranteed as they depend on external factors beyond the Seller’s control and responsibility.

6.3 – Deliveries are made on working days to the address provided at the time of ordering. In case of absence of the recipient, the courier may attempt one or more delivery attempts or provide instructions for rescheduling. If delivery is unsuccessful, the shipment may be returned to the sender.

6.4 – At the time of shipment, the Seller or the courier will provide a tracking number allowing the User to monitor the delivery status via the courier’s website. Upon delivery, the integrity of the package or parcel may be checked. Any damage must be reported by means of a written and justified reservation (e.g. “damaged packaging” or “torn parcel”). Only in the presence of such reservation may a refund procedure be initiated.

6.5 - In the event that goods are not received within the timeframe indicated in the shipping confirmation emails, the Buyer may contact the Seller’s Customer Service at the email address provided on www.negoziboschini.it.

6.6 - The delivery address used is the one provided at the time of order confirmation. The Buyer is responsible for verifying that the address is complete and correct in all its parts, in order to avoid delivery issues. It is also recommended to provide a telephone number to allow the courier to contact the Buyer in case of delivery problems.

7 - Right of Withdrawal

7.1 - Return shipping costs shall be borne by the Buyer. To exercise the right of withdrawal, the Buyer must follow the return procedure available on the website or contact Customer Service using the contact details provided. Return shipping costs, any related expenses, and responsibility for the goods until receipt confirmation by www.negoziboschini.it shall be entirely borne by the Buyer. If the return shipment does not reach its destination for any reason, the price of the product will not be refunded.
Each item must be returned intact, unused, and complete with all components and accessories received, in the same condition in which it was delivered. In the event of receipt of defective goods or errors attributable to the Seller in order fulfilment, return shipping costs shall be borne by the Seller. The Customer must report the issue by contacting Customer Service, providing a description of the defect and supporting photographic evidence. The product must be returned intact, unused, and complete with all original elements (including labels, dust bags, and packaging, where applicable), in the same condition in which it was received. Returns are subject to verification and must be previously authorised by the Seller. Once authorisation has been granted and product inspection completed, the refund will be processed in accordance with the applicable procedures.

7.2 - The Buyer has the right to withdraw from the contract concluded with the Seller, without penalty and without providing any reason, within fourteen (14) days from the date of receipt of the products purchased on www.negoziboschini.com. In specific cases, duly indicated in the Right of Withdrawal section, it may be possible to exchange the selected product for another item.

7.3 - The right of withdrawal may be exercised by completing the Return Form available on the website.

7.4 - Once the withdrawal has been exercised, the Buyer must return the products to the Seller by handing them over to the courier within fourteen (14) days from the date of communication of the decision to withdraw from the contract.

7.5 - Costs borne by the Buyer include the return of the products and any related expenses applied to the return shipment, which will be deducted from the refund amount, unless expressly waived by the Seller at the time of purchase.

7.6 - In the event of refusal to accept delivery of the products without a justified reason promptly communicated to Customer Service (www.negoziboschini.it), or in the absence of a complete shipping address, the Buyer shall not be entitled to a full refund of the amounts paid. In such case, the shipping costs for delivery to the customer and return to the Seller will be deducted from the refund.

8 – Refund times and methods

8.1 – Following the return of the products, the Seller reserves the right to verify their compliance with the return conditions. In the event of a positive outcome, the refund will be processed according to the applicable procedures. If a reduction in the value of the products is found, the Seller reserves the right to apply a reduction in the refund amount or to return the products to the Buyer.

8.2 – Regardless of the payment method used for the purchase, the full or partial refund shall be initiated by the Seller as soon as possible and in any case within fourteen (14) days from the date of receipt of the returned products, subject to verification of the correct exercise of the right of withdrawal and the conformity of the returned goods.

8.3 – The Seller shall issue the refund using the same payment method used by the Buyer for the purchase of the products, unless expressly agreed otherwise, provided that the Buyer does not incur any additional costs as a result of the refund. Where the recipient of the products indicated in the order form differs from the person who made the payment, the refund shall be issued to the party who made the payment.

8.4 - The value date of the refund shall correspond to the original debit date, ensuring that no loss of bank interest occurs. If the Buyer chooses to use a carrier other than the one indicated by the Seller for returning the products, all shipping costs, including VAT, as well as responsibility for any loss or damage to the products, shall be borne by the Buyer.

10 – Customer Service

10.1 The Customer may request any information through our Customer Service channels available in the “Contacts” section, or by sending an email to the relevant address, as well as by contacting one of our stores by telephone using the numbers provided on the website.

11 - Governing Law and Dispute Resolution

11.1 - These General Terms and Conditions of Sale are governed by Italian law (in particular Legislative Decree No. 206 of 06/09/2005 – which, under Articles 50 to 67, regulates distance contracts – and Legislative Decree No. 70 of 09/04/2003 on electronic commerce) and shall be interpreted accordingly.

11.2 - Pursuant to Article 14 of EU Regulation No. 524/2013, consumers residing in the European Union are informed that, in the event of a dispute, they may submit a complaint via the European Online Dispute Resolution (ODR) platform, accessible at the following link: https://ec.europa.eu/consumers/odr/. The ODR platform provides a point of access for consumers seeking to resolve disputes arising from online sales or service contracts out of court. In any case, the Consumer retains the right to bring proceedings before the competent court.

11.3 – Competent Jurisdiction

For any dispute arising from or in connection with these General Terms and Conditions of Sale, if the Customer is a consumer, the competent court shall be exclusively the court of the place of residence or domicile of the consumer. If the Customer acts in the course of their business, commercial, craft, or professional activity, the exclusive competent court shall be the Court of Chieti.

12 - Amendments and Updates

12.1 - These General Terms and Conditions of Sale may be amended from time to time, including in light of any regulatory changes. The new General Terms and Conditions of Sale shall be effective from the date of publication on www.negoziboschini.it. Users are therefore advised to consult the website regularly to check for any updates.
